Case Studies

In a recent reported case involving a council worker with an unblemished long service prior to her being placed in a managerial role and encountering difficulties, the employer’s failure to use a fair review process, in particular adopting a “backseat” approach to supervision and not setting achievable or measurable targets for improvement, rendered the dismissal unfair.

Our proactive and vigilant approach ensures that robust and fair sanctions can be confidently taken against poor performers.

In another case involving a bus driver who was dismissed after testing positive for cocaine in a saliva test, the claimant took a separate follicle test to show he was clear and that the drug had been transmitted via contaminated bank notes. He won his unfair dismissal case -and a compensation award of £84,000- because this line of reasonable defence was not followed up.

We carefully guide our clients through an appropriate investigatory and disciplinary procedure to ensure the process is not vulnerable to such an attack in any subsequent tribunal proceedings.
