Redundancy and TUPE

When a business is bought or sold its employees may be protected under the Transfer of Undertakings (Protection of Employment) regulations (TUPE). It is important to get the right advice, because any and all employees who are dismissed unfairly and in breach of the regulations can take their employer to a tribunal and claim, in addition to the normal compensatory amounts, up to 13 weeks pay (uncapped and per each employee) as a penalty payment for failing to get the procedure right.

How can we help?

We can provide help and guidance, so you comply with the law. We can also advise on:

  • informing and consulting with any trade union or employee representatives
  • transfers of employment contracts and HR records and how to deal with disclosure of employee data so as not to breach data protection laws
  • making employees redundant and whether they are entitled to a redundancy payment (an employer cannot necessarily make employees redundant just because there is a business transfer or a service is being outsourced)
  • handling employees being transferred from an insolvent business.

We can act either on a “pay as you go basis” or a fixed fee retainer basis under our Bulldog HR scheme.
